How does a separation agreement work?

A married couple can establish a separation agreement in lieu of filing for a divorce, but the separation agreement must be fair, equitable, and transparent for both parties if it is to be considered legally binding. In certain scenarios, such an agreement essentially provides the same outcome as a legal separation would in other states. The key difference is that the court would not resolve disputes regarding the agreement. This means that the spouses must submit to the terms of the agreement on their own accord as they would any other contract.
