Approved in 1977, The Fair Debt Collection Practices Act (FDCPA) is a federal law that is actually an amendment to the Consumer Credit Protection Act. Congress enacted it to provide additional protections for consumers who are being treated unfairly or harassed by debt collectors or third party debt buyers in violation of the law. The act created guidelines by which debt collectors must comply, penalties for violations of the act, and set forth the rights and protections of consumer debtors.

Under the FDCPA, behavior that undermines the dignity or privacy of a consumer is prohibited. This includes:

Late night phone calls
Harassing family members/neighbors
Slandering your name/reputation
Threatening with a lawsuit (without the authority to do so)
Publishing debt information
Profane or demeaning language
Calling your workplace without permission
Failing/refusing to identify themselves
