Florida Consumer Collection Practices Act
Your Rights Under the FCCPA
Much like the Fair Debt Collection Practices Act (FDCPA), the Florida Consumer Collection Practices Act (FCCPA) protects consumers from abusive and deceptive debt collection practices exercised by debt collectors and creditors. It essentially codified the federal FDCPA and strengthened it for Florida consumers. The act extends not only to debt collectors and third party debt buyers, but also creditors, as the FDCPA did not extend to the original creditors themselves.
Violations of the FCCPA
The team at Your Advocates is extremely familiar with the differences between the two co-existing laws, and are experienced at helping Fort Myers and Lee County consumer debtors who are being unfairly treated and harassed by debt collectors and creditors who engage in collection practices prohibited by the FCCPA.
If you have received calls of the following natures, you have likely received calls which are in violation of the provisions of FCCPA:
- From people posing as police officers or representatives of a government agency
- From collectors threatening to talk to your employer without having obtained a judgment
- From people falsely presenting themselves to be attorneys
Contacting you between 9:00 PM and 8:00 AM without your permission or contacting your family and friends are also violations of the Florida Consumer Collection Practices Act. The act provides for penalties in the form of monetary compensation to you, possible punitive damages (increasing your compensation by as much as three times) and actual damages if you have sustained financial losses due to the offender's actions.
