Florida Statute § 316.061

Being involved in a car accident can be a potentially jarring experience. If you have been involved in a car accident in the state of Florida, Florida Statute § 316.061 requires you to remain at the scene of the accident until the appropriate information has been exchanged between all parties involved.

This information includes:

  • Your name,
  • Address, and
  • The registration number of your vehicle.

Additionally, if you are asked, you must provide a copy of your Driver’s License to any police officer investigating the accident. A violation of this section will result in a second-degree misdemeanor.

Florida Statute § 316.062 requires that if you happen to be at fault for the accident and it results in the injury or death of another person, you must render reasonable assistance to the offended party. This includes taking the injured party to a hospital or medical provider. If you or your vehicle are incapacitated to the point that you can’t complete this task yourself, you must call an ambulance to transport the injured party to a hospital or medical provider. Violating this statute is considered to be a noncriminal traffic infraction, punishable as a nonmoving violation.
