Nursing care, child brain injury. A young child suffering from numerous medical problems including neurological and physical injuries with partial paralysis received home nursing care assistance. The nurse failed to monitor the child correctly and improperly performed CPR when his breathing had ceased. The child suffered additional brain injury. The nursing care company was a conduit for independent contractors (nurses) with no assets except its insurance policy of $3 million. The insurance company paid the policy limits approximately 1½ years into litigation.
