We Can Simplify a Complex Probate Situation for You

AARP discountsSummary Administration provides for a streamlined probate process for interested parties if:

  • The value of the estate is under $75,000
  • More than two years have passed since the decedent's date of death

A full and formal administration is required for estates that do not match this criteria. Formal administration may also be suggested for smaller estates that qualify for summary administration but the will is contested, beneficiaries cannot be located, or there are multiple creditors to satisfy.

If a decedent is domiciled outside of the State of Florida but possesses assets which are located within the State of Florida, an ancillary probate administration will be necessary to transfer those assets to intended beneficiaries.

When No Probate Is Permitted

Additionally, when the deceased person's property is not of great value, the law allows for disposition without administration, or "no probate." This grants reimbursement from the estate to whoever paid for the deceased's final expenses, such as funeral costs and remaining medical bills. Disposition without administration does not apply when the assets include any real estate or when debts and final expenses exceed the value of the assets.
